The Foothills School Division Board of Trustees is filing an application to the courts, in accordance with the Local Authorities Education Act, to see what their next steps should be concerning the Ward One byelection.

Former trustee Jeannine Tucker was disqualified after the last election, but ran in the byelection, only to take herself out of the running by filing a disclaimer, which acts as a disqualification, two working days before the election.

Board chair Larry Albrecht says they are going to the court to clarify the impact on the election of one candidate issuing a disclaimer and resiging from the position of trustee in advance of the election to determine if the Court will declare the only other candidate Jack Molyneux elected by acclamation.

"Due to the exceptional set of circumstances our administration has reached out to the provinical government as well as our legal counsel to ensure that we are acting prudently and responsibly moving forward."

Albrecht adds as there is no best course, they decided the correct course of action is to have the court provide clarification to enable the board to move forward as quickly as possible to fill the Ward One trustee vacancy.

"We look forward to having these questions answered as expeditiously as possible."
